Family Based: Preference Categories

FB1-Unmarried Sons and Daughters of U.S. Citizens

The first family-sponsored preference is set aside for unmarried sons and daughters of U.S. Citizens, who are 21 years old or older.   The term “unmarried” includes individuals who were never married and divorced and widowed individuals.  The U.S. Citizen Parent may petition their unmarried adult sons and daughter for green cards under this preference category. 

FB2 -Spouses of Permanent Residents, Children of Permanent Residents, Unmarried Sons and Daughters (over 21) of Permanent Residents

The second family-sponsored preference is set aside for two groups.  Preference Group 2A includes spouses and unmarried minor children of permanent residents (green card holders).    

Permanent Residents: The U.S. Permanent Resident may sponsor their spouse and unmarried minor children for green cards under this preference category.   The term “unmarried” includes individuals who were never married and divorced and widowed individuals. 

Children of Permanent Residents: The U.S. Permanent Resident may sponsor their spouse and unmarried minor children for green cards under this preference category.   The term “unmarried” includes individuals who were never married and divorced and widowed individuals. 

Unmarried Sons and Daughter (over 21): The U.S. Permanent Resident may sponsor their unmarried sons and daughters for green cards under this preference category. 

FB3 – Married Sons and Daughters of US Citizens:

The third family-sponsored preference is set aside for married sons and daughters (individuals who are 21 years old or older) of US Citizens.     The U.S. Citizens may sponsor their married sons and daughters for green cards under this preference category.   

Family Members:

Spouse and children (under 21 and not married) of the married sons and daughters of U.S. Citizens are eligible to obtain derivative permanent resident status (green card) when the married son or daughter of the U.S. Citizen obtains their green card.  They are allowed to accompany the married son or daughter and remain in the United 

FB4 – Siblings of US Citizens

The fourth family-sponsored preference is set aside for brothers and sisters of US Citizens.     The U.S. Citizens must be at least 21 years old to sponsor their brothers and sisters for green cards under this preference category. 

Family Members:

Spouse and children (under 21 and not married) of the brothers and sisters of U.S. Citizens are eligible to obtain derivative permanent resident status (green card) when the brother or sister of the U.S. Citizen obtains their green card.  They are allowed to accompany the brother or sister and remain in the United States.
